These terms of business of “BTO Ltd.” (hereinafter referred to as “vendor”) are valid for all sales, deliveries and services of the vendor which the customer buys from the vendor via www.bto.pl An entrepreneur is any natural person or legal entity or a partnership with legal capacity who/which, making a legal transaction, acts in pursuance of his or her/its independent professional or commercial activity.

Conclusion of a Contract

The purpose of the product depictions in the vendor’s online shop is the making of a legally binding offer to buy by the customer.

The customer can make the offer to buy in writing, by fax, by e-mail or via the online order form integrated in the vendor’s online shop. In case of a purchase via online order form the customer, after entry of his or her personal data and by clicking the button “confirm order”, makes a legally binding offer to buy concerning the goods in the shopping basket in the final step of the order process. Before placing a binding order, all the entries can continually be corrected using the usual keyboard and mouse functions. Moreover, before placing a binding order, all entries are displayed once again in a confirmation window and can also be corrected there using the usual keyboard and mouse functions.
The vendor will immediately confirm the receipt of the customer’s offer to buy in an electronic way (by fax or e-mail). A sale contract only comes into being by means of a written confirmation of order by the vendor, but, at the latest, by means of the unconditional acceptance of the goods by the customer. The vendor is entitled to accept the customer’s offer within five working days after receipt by the vendor. If the vendor delivers the ordered goods within this period of time, this will be regarded as an acceptance. The vendor is entitled to refuse the acceptance of the order – for instance after examination of the customer’s credit worthiness.
If the order takes places electronically, the wording of the contract (consisting of the order data and the general terms of business) will be saved by the vendor and sent to the customer after conclusion of the contract.
The customer has to ensure that the e-mail address given by him for the purchase processing is correct so that he can receive the vendor’s e-mails via that address. In particular, if the customer uses SPAM-filters, he has to ensure that all e-mails sent by the vendor or his purchase processing service providers can be received for purchase processing.

Prices and Payments

The indicated prices of the vendor are retail prices, i.e. they comprise all cost elements including the legal value added tax, which, on the other hand, is shown separately.
The vendor’s invoices are payable per PayPal system.

If advance payment is agreed upon, the payment has to be made within 7 (seven) days after conclusion of contract. The moment of receipt of money by the vendor is decisive.

Conditions Of Delivery And Shipping As Well As Passing Of Risk

The delivery of goods regularly takes place by shipping and to the delivery address indicated by the customer. For the processing of the transaction, the delivery address indicated by the customer in the vendor’s purchase processing is exclusively decisive.
If a delivery to the customer is not possible, the hired forwarder (DPD in UE or Poczta Polska in whole world) will return the goods to the vendor after the third unsuccessful delivery attempt. Before the return, a last contacting over the telephone is attempted by the forwarder in order to arrange an encounter or a potential hand-over point. The customer has to bear the costs for the unsuccessful deliveries only after the fourth and therefore last unsuccessful delivery attempt and the resulting return. This does not apply if the customer is not responsible for the unsuccessful delivery attempts.

Returns & Refund Guarantee

Returns & Refund is a guarantee provided by BTO for every product they sell on bto.pl
When you receive a product that was bought and paid for on our site, and you find it is not as described or is of low quality, you can submit refund requests up to 15 days after your order has been completed. You will then be able to request a full refund and return the item, or keep the item and agree a partial refund with seller.

Refunds are not offered for battery packs, which are services performed under the customer request.

Warranty

All goods available online BTO are subject to manufacturer's warranty. Battery packs are warranted for 6 months. In the event that the goods supplied is the original manufacturer's warranty, warranty make authorized service points. In other cases, any defects should be reported to our company, as a seller of goods.

Our limited warranty DOES NOT COVER:

  • Physical damage to the products.
  • Any permanent marks or scuffs on the items.
  • Damage of failure resulting from improper or abnormal use, improper or abnormal storage, misuse, abuse, misapplication, or tampering

This limited Warranty is VOID:

  • If a product has been altered or modified in any way
  • If a product's original label or trademark, patent, serial number, any of its trade dress or other marking or identifications have been removed, defaced, altered or modified
  • If a product is used contrary to instructions
  • Lithium Polymer and Li-ion batteries are volatile. Failure to read and follow the below instructions may result in fire, personal injury and damage to property if charged or used improperly.
  • By purchasing Lithium Polymer and Li-ion battery, the buyer assumes all risks associated with lithium batteries. If you do not agree with these conditions, please consider Nimh or Nicd battery or return the battery immediately before use.
  • Li-Ion and Polymer battery & packs may explode and cause fire if misuse or defective. We require all Li-ion batteries & packs buyers must be professionals and have capability to handle emergency.
  • Must follow our instruction exactly which is listed on bto.pl product page to control charging and discharging current. - When charging Battery Pack, please put battery in a fire proof container. Please don't leave battery pack and charger on the wood material or carpet and unattended.
  • Must keep Li-Ion & Polymer battery pack away from children.
  • Never make wrong polarity connection when charging and discharging battery packs. Always double check polarity of battery's connector to make sure red wire to red wire and black wire to black wire. - Warranty does’t cover lithium-ion (Li-ion) and lithium-iron-phosphate (LiFePO4) cell, which noted a trace of interference in the cell, eg. Cells were independently welded / soldered, combined into battery packs
  • Guarantee are not subject cells discharged below the threshold for Li-ion 2.4V or LiFePO4 2V and overloaded above the threshold for 4.2V Li-ion and LiFePO4 3,65V. - Warranty does not cover battery packs and Li-ion (lithium-ion) / LiFePO4 (lithium iron phosphate) cells bought in our shop without protection system PCM / PCB / BMS. In this case, the client waives all rights of warranty from the purchase of Li-ion (lithium-ion) / LiFePO4 (lithium iron phosphate) without protection system cells PCM / PCB / BMS and is aware of all the dangers of their improper use and at the same time takes responsibility for their use.
  • Security systems PCB with balancer, which are not mounted in the conditions of ESD is not covered by the warranty.

Liability

In case of violation of life, body or health, in case of intention or gross negligence, malice and promise of warranty and if the liability takes place according to compelling statutory provisions like the product liability act for instance, the vendor is unreservedly liable on every legal basis.
For the rest, the vendor is liable as follows, irrespective of legal basis.
If the vendor has negligently breached an essential contractual obligation (a so-called cardinal obligation), the duty of replacement for material damage is restricted to the foreseeable typically arising average damage.
If the vendor has negligently breached an unessential contractual obligation, the duty of replacement is restricted to the order value.
Batteries containing pollutants are marked with a crossed-out dustbin. Under the dustbin-symbol there is the chemical designation of the pollutant – for example “Cd” for cadmium. “Pb” stands for lead, “Hg” for mercury.
The customer can also read again this information in the shipping documents of the shipment or in the instruction manual of the manufacturer.
The contractual language is Polish.
